Dealer Terms & Conditions

Dealer Agreement

These Dealer Terms and Conditions ("Dealer Terms") govern your use of the LuxCredo Luxury Marketplace platform as a verified dealer. By listing vehicles on LuxCredo, you agree to these terms in addition to our general Terms of Service.

Dealer Eligibility

To become an LuxCredo dealer, you must:

  • Hold a valid dealer license in your jurisdiction
  • Maintain all required business licenses and permits
  • Have a minimum of 2 years operating history
  • Specialize in luxury, exotic, or high-end vehicles
  • Maintain professional liability insurance
  • Pass LuxCredo's verification process
  • Maintain a physical dealership location or showroom

Listing Requirements

Vehicle Documentation

All listings must include:

  • Clear title or proof of ownership
  • Complete vehicle history report
  • Current odometer reading
  • Detailed condition report
  • Maintenance and service records
  • High-quality photographs (minimum 10 images)

Accuracy Requirements

You agree to:

  • Provide accurate and truthful information about all vehicles
  • Disclose any known defects, damage, or modifications
  • Update listings promptly when vehicle status changes
  • Remove sold vehicles within 24 hours
  • Maintain accurate pricing and availability

Fees and Payment Terms

Listing Fees

  • Monthly subscription fee based on selected tier
  • Per-listing fees for premium placements
  • Success fees upon completed transactions (if applicable)
  • Featured listing upgrade fees

Payment Terms

  • All fees are due monthly in advance
  • Payments processed via ACH or credit card
  • Late payments subject to 1.5% monthly interest
  • Listings may be suspended for non-payment

Dealer Responsibilities

Customer Service

  • Respond to inquiries within 24 hours
  • Maintain professional communication at all times
  • Facilitate vehicle inspections upon reasonable request
  • Provide accurate delivery timelines
  • Honor advertised prices and terms

Compliance

  • Comply with all applicable laws and regulations
  • Maintain proper licensing and insurance
  • Follow fair lending practices
  • Adhere to advertising standards
  • Comply with consumer protection laws

Prohibited Activities

Dealers are strictly prohibited from:

  • Listing stolen, salvaged, or flood-damaged vehicles without disclosure
  • Misrepresenting vehicle condition, history, or specifications
  • Manipulating odometer readings or documentation
  • Engaging in bait-and-switch tactics
  • Discriminating against buyers based on protected characteristics
  • Soliciting buyers outside the LuxCredo platform
  • Sharing or selling buyer contact information
  • Listing vehicles you do not own or have authorization to sell

Quality Standards

LuxCredo maintains high marketplace standards. Dealers must:

  • Maintain a customer satisfaction rating of 4.0 or higher
  • Respond to 90% of inquiries within 24 hours
  • Complete 90% of transactions without buyer complaints
  • Maintain accurate inventory (less than 5% error rate)
  • Follow through on all commitments to buyers

Dispute Resolution

In case of disputes between dealers and buyers:

  • Dealers must attempt to resolve issues directly with buyers
  • LuxCredo may mediate disputes at its discretion
  • Dealers must cooperate with LuxCredo investigations
  • LuxCredo reserves the right to issue refunds on dealer's behalf
  • Unresolved disputes may result in suspension or termination

Suspension and Termination

LuxCredo may suspend or terminate dealer accounts for:

  • Violation of these Dealer Terms
  • Fraudulent or deceptive practices
  • Excessive buyer complaints
  • Non-payment of fees
  • Loss of required licenses or insurance
  • Damage to LuxCredo's reputation

Upon Termination:

  • All listings will be immediately removed
  • Outstanding fees become immediately due
  • Access to dealer portal will be revoked
  • Pending transactions must be completed or refunded

LuxCredo's Role and Liability

LuxCredo acts solely as a marketplace platform:

  • LuxCredo does not take ownership of listed vehicles
  • Dealers are responsible for all transactions
  • LuxCredo is not liable for dealer misconduct or errors
  • Dealers must indemnify LuxCredo against buyer claims
  • Dealers maintain all liability for vehicle condition and sales

Data and Privacy

Regarding buyer data:

  • Use buyer information only for completing transactions
  • Never share or sell buyer contact information
  • Comply with all applicable privacy laws
  • Protect buyer data with appropriate security measures
  • Delete buyer data upon request or as required by law

Modifications to Terms

LuxCredo reserves the right to modify these Dealer Terms at any time. Dealers will be notified of material changes via email. Continued use of the platform after modifications constitutes acceptance of the updated terms.
